The U.S. Senate approved far-reaching anti-terrorism legislation late last
night, rejecting efforts to limit the measure’s impact on the privacy and
civil liberties of American citizens. The Uniting and Strengthening
America Act (S. 1510) was the product of negotiations between the Justice
Department and the Senate leadership. In an unusual departure from normal
legislative procedure, the bill was sent directly to the full Senate
without any debate or consideration by the Senate Judiciary Committee.
Sen. Russell Feingold (D-WI) and other colleagues, including Paul Wellstone
(D-MI) and Maria Cantwell (D-WA), unsuccessfully attempted to have the
Senate vote on three amendments designed to minimize the impact on civil
liberties. “What have we come to when we don’t have either committee or
Senate deliberation or amendments on an issue of this importance?” Feingold
asked. “Each of us cares as much as anyone in this room about the fight
against terrorism, but we want to make sure we don’t go beyond that goal
and intrude on our civil liberties.” The unamended bill was approved by
a 96-to-1 vote, with Feingold dissenting.

Draft legislation, proposed only just days abo (19-Sep) seeks to deny
Americans the right to privacy by mandating government backdoors in all
encryption products. This right on the heels of 13-Sep’s “Combating
Terrorism Act” which proposes similar injunctions on the freedom and
liberties of American citizens and was rushed through with less than 30
minutes of consideration on the senate floor.

The ATA/MATA draft bill is expected to go to vote as early as this week.
If you’re in the united stats, this bill can and will have serious impact
on your privacy. Please consider contacting your representatives and
those on the senate committee considering the bill to voice your concern
for this erosion of privacy in the dubious name of combating terrorism.

The EFF has an excellent summary of the situation with pointers to the
relevant facts and elected officials. Even something as simple as one
email to the senate subcommit te can make a difference.

The events of 11-Sep are horrific to us all, but we can’t expect to defeat
an attack on freedom by destroying those freedoms ourselves.

Please consider adding your voice to the debate before it’s too late.

Made a major breakthrough on the Sybase difficulties we’ve been having on
the new statsbox which puts us a hell of a lot closer to being able to
migrate to the new hardware. Many thanks to Vladimir Silyaev for
confirming, explaining, and providing what looks to be a workable remedy
to the problems.

I spent some time this morning updating the documentation on how to use
IRC to chat with other distributed.net users and staff. The new document
includes information on the new irc-ssl encrypted irc feature and has
scripts for accessing the nick and channel services offered by the new
network.

Well, since it’s hit slashdot and I’m getting lots of mails asking if
we’re aware of the situation, I thought I’d post a plan explaining
distributed.net’s perspective on David McOwen and the State of Georgia.

distributed.net can confirm that at least some part of what’s being reported
is accurate. We were subpoenaed for information relating to Mr. McOwen’s
participation in the RC5-64 project and supplied that information as
requested. We also spoke at length with representatives of the prosecution
to make sure they understood the actual impact of the dnetc software on
the machines and networks in question.

However, part of the subpoena restricts us from commenting on the details
of pending litigation. Especially since we do not know the details or
circumstances of the alleged activity, we do not want to do anything which
would endanger either party’s position in this case. We trust that the
community understands our position in this matter.

In the more general sense, not commenting at all on the specifics of this
case, it is never a good idea to run the distributed.net client software
on computers you don’t own or administrate. In the four years or so that
we’ve been in operation we’ve been dragged in to a handful of situations
where people have lost their jobs, positions, and scholarships by thinking
that forgiveness would be easier to obtain than permission. Nobody,
especially distributed.net, wants to see this happen.

It’s important to keep in mind that the literal resource consumption of
the client (which is as close to “zero” as can be) is often not the only
factor important to a business. The existence of prize money with the
RC5-64 project is discomforting to many organizations. One tactic which
has proven to be very effective is to provide an affidavit that you will
donate any winnings to a charity if a client you installed on a company
or university machine finds the winning key. In many cases, this has been
key to a participant receiving permission to run the client on non-owned
resources.

Another frequent stumbling block is with service and support contracts
which prohibit non-certified software running on workstations or servers.
Your university or employer may risk losing support on their equipment if
software is installed that hasn’t been explicitly mentioned in the support
agreements.

The bottom line is, always get permission first. It might not be as
difficult to get permission as you think. And if you can’t get permission,
don’t install the client.

We hope for a speedy and just resolution to this case, whatever that
outcome should be, and that we never have to be involved in another one.

Well, distributed.net has just spent the largest single sum of money it’s
ever spent (barring prize payments). It’s well-past time to upgrade our
aging keymaster, so I just placed an order for a nice Dell PowerEdge 2550.

The new box will add reliability in the form of RAID and the twin CPUs
will take advantage to the better threading model that cow recently added
to the master code. We’ll also really appreciate the additional drive
space.

I apologize for letting the ledger fall a bit stale lately, we’ve changed
banks (with my move to Austin) and I haven’t found the time to bring the
online register up to date. I will get it updated this week to reflect
this purchase as well as other spending that DCTI has made.
